Lux_Loot Consignment Terms & Conditions
By submitting a Consignment Agreement Form and shipping items to Lux_Loot, the Consignor (the "Seller") agrees to be bound by the following terms and conditions:
1. Ownership and Authenticity

The Consignor warrants that they are the sole legal owner of all items submitted and that the items are free from any liens or encumbrances.

The Consignor guarantees the authenticity of all items. If an item is found to be counterfeit, altered, or tampered with, it will be returned at the Consignor’s expense, and a $20 processing fee per item may apply.
2. Fees and Payouts

Consignment Fee: Lux Loot charges a service fee of 3.1% of the final gross sale price.

Transaction Fee: A payment processing fee of 2.9% + $0.30 will be deducted from the final sale price.

Shipping & Packaging Fee: A flat fee of $5.00 per shipment will be deducted from the final sale proceeds to cover shipping materials, packaging, and postage costs.

Payouts: Net proceeds (Final Sale Price minus all applicable fees, transaction costs, and shipping & packaging charges) will be issued to the Consignor within 7–14 business days of the buyer's payment being cleared and the order being marked as completed..
3. Shipping and Risk of Loss

Incoming: The Consignor is responsible for all costs and risks associated with shipping items to Lux_Loot. We strongly recommend using tracked and insured postage with signature requirements. Lux_Loot is not liable for items lost or damaged in transit to our facility.

Storage: While in our possession, Lux_Loot will handle all items with professional care. However, Lux_Loot is not liable for minor "shelf wear" or inherent defects in the item's materials.

Outgoing (Returns): If an item is unsold and must be returned, the Consignor is responsible for return shipping costs unless otherwise agreed upon in writing.
4. Pricing and Sales Strategy

The Consignor provides a "Nomination Price" or "Market Percentage" as a guide. Lux_Loot reserves the right to decline listings if the nominated price is deemed significantly higher than current market trends, as this hinders saleability.

For Auctions, the final sale price is determined by the highest bidder. Lux_Loot does not guarantee that auctions will reach the Consignor's "Nomination Price" unless a formal Reserve Price is agreed upon in writing.
5. The 90-Day Listing Period & Buyout Clause

This agreement is active for 90 days from the date the item is listed on the Lux_Loot website.

The Buyout Option: After 90 days, Lux_Loot may offer to purchase the item(s) directly from the Consignor at 70% of the current market value.

Note: This is an optional offer made at the sole discretion of Lux_Loot and is not a guaranteed obligation to purchase.

Extension: If no buyout offer is made or accepted, the Consignor may sign a new agreement to extend the consignment for another 90 days.

Early Withdrawal: If the Consignor wishes to withdraw an item before the 90-day period ends, a $15 early withdrawal fee per item will apply to cover labor and listing costs.
6. Market Volatility

The Trading Card Game (TCG) market is highly volatile. The Consignor acknowledges that "Market Value" is a moving target and can fluctuate daily.

While Lux_Loot monitors and updates pricing regularly, sudden market fluctuations may result in a card selling below a previously recorded market price.

Lux_Loot is not liable for any perceived loss of value due to these rapid market shifts or for any decrease in the market value of items while they are held for the consignment period.

Once an item is sold, the sale price is final and will not be adjusted based on subsequent market increases or decreases.

7. Dispute Resolution

This agreement is governed by the laws of New South Wales, Australia. Any disputes arising from this agreement shall be resolved through good-faith negotiation or, failing that, through the appropriate local small claims tribunal or court.

This document specifically protects you during the buyout process, ensuring you aren't stuck with cards that arrive in poor condition or aren't authentic. It clearly defines the "70% to 85%" range as a discretionary offer, not a guarantee.
Lux_Loot Direct Buyout Terms & Conditions
By submitting a Buyout Submission Form and shipping items to Lux_Loot, the Seller (the "Consignor") agrees to the following legally binding terms:
1. Nature of the Transaction

This is a Direct Purchase Agreement. Once a buyout offer is accepted and payment is issued, ownership of the items transfers immediately and irrevocably to Lux_Loot.

Lux_Loot is under no obligation to purchase any item submitted and reserves the right to decline any buyout request at its sole discretion.
2. Condition & Market Assessment

Final Grading: All preliminary quotes provided via email or social media are non-binding estimates. A final offer will only be made after a physical inspection by Lux_Loot.

Condition Standards: Lux_Loot uses industry-standard grading (Near Mint, Lightly Played, Moderately Played, Heavily Played, Damaged). Our physical assessment of a card’s condition is final.

Market Data: "Market Value" is determined by Lux_Loot using the most recent "Sold" data from verified platforms (e.g., eBay Sold Listings, TCGPlayer, or PriceCharting).
3. The Buyout Pricing Tiers
-
Standard Rate (70%): Our baseline offer for most authentic TCG cards in Near Mint (NM) or Lightly Played (LP) condition is 70% of the current market value.

Premium Rate (Up to 85%): At the sole discretion of Lux_Loot, certain high-demand "chase" cards, high-grade professionally slabbed cards (PSA/BGS/CGC), or specific inventory needs may qualify for a premium rate of up to 85% of market value.

Sub-Standard Items: Items assessed as Moderately Played (MP), Heavily Played (HP), or Damaged will be valued significantly lower than the standard 70% NM rate, or may be rejected entirely.
4. Authenticity & Legal Ownership

The Seller warrants they are the legal owner of the items and that they are 100% authentic.

Counterfeit Policy: If any items are found to be counterfeit or altered, no offer will be made. The items will be returned to the Seller only after a $20 authentication & processing fee (plus return shipping) is paid. If unpaid after 30 days, the items will be destroyed.
5. Shipping & Risk of Loss

Inbound: The Seller is responsible for all shipping costs and risks when sending cards to Lux_Loot. We strongly recommend tracked and insured postage. Lux_Loot is not liable for items lost or damaged by the postal service.

Outbound (Returns, Declined Offers & Abandoned Property)
1. Responsibility for Return Costs: In the event that a Consignment period ends without a sale, or a Direct Buyout offer is declined, the Seller is solely responsible for all return shipping, insurance, and handling costs ("Return Charges"). Items will not be released until all Return Charges and any applicable Administrative Fees (as specified in Section 2) are paid in full.
2. Initial Notice Period: Upon the conclusion of an assessment or listing period, Lux_Loot will issue a shipping invoice to the email address provided in Section 1. The Seller has 14 days from the date of this invoice to provide payment.
3. Final Notice & Intention to Dispose: If the invoice remains unpaid after 14 days, Lux_Loot will issue a Final Notice of Intention to Dispose of Uncollected Goods. This notice grants a final 14-day grace period to settle the debt.
4. Right to Sell to Recover Costs: In accordance with the Uncollected Goods Act 1995 (NSW), if all charges remain unpaid after the 28-day total notice period, Lux_Loot reserves the right to sell one or more of the items at fair market value (via public auction or current market rates) to recover the outstanding debt.
5. Allocation of Proceeds: Proceeds from such a sale will be applied in the following order:

A. To the costs of the sale (e.g., platform fees, commissions).

B. To the outstanding Return Charges, Administrative Fees, and any accrued Storage Fees ($5 per week after the initial 14 days).

C. Any surplus funds and remaining unsold items will be returned to the Seller's nominated account/address.
6. Abandonment: If the Seller cannot be contacted or fails to provide payment/collection instructions for a period exceeding 6 months, any surplus funds may be dealt with as "Unclaimed Money" in accordance with NSW Treasury requirements.

6. Market Volatility & Offer Validity

TCG markets are highly volatile. All formal buyout offers sent via email are valid for 48 hours.

If items are not received within 7 business days of an initial estimate, Lux_Loot reserves the right to adjust the offer based on updated market data upon arrival.
7. Payment

Once an offer is accepted, payment will be issued via the Seller's chosen method (Bank Transfer or PayPal) within 24–48 hours.

Finality: All buyout sales are final. Once payment is sent, the Seller cannot request the return of the items or a price adjustment based on subsequent market increases.
